I receive instructions to that effect from the Secretary
of State, I should not feel justified in adopting the
course Your Honour proposes. The suggestion however, will
be within the cognizance of the Secretary of State when
he peruses the exhaustive criticisms contained in your
letter and its enclosure.

I turn to the general statements (apart
from specific requests) made in your letter. In regard
to the obligation of the Executive Council to give reasons
for its decision, I regret that as I said verbally to Your
Honour I cannot concur in the universal application of
this dictum. Nor can I concur that the kxecutive Council
did not exercise their advisory functions independently
(para.6). The Council heard what the Secretary of State
had written and 'functus officio' formed their decision.
It is beyond my competence to comment
upon the observations you have made regarding the action
of the Secretary of State for Foreign Affairs and the
Secretary of State for the Colonies, but I may observe
that I see no reason wharever for discarding the inter-
pretation I put upon that action viz. that the Secretary
of State would naturally be averse to introducing a scheme
which would "alater fundamentally the judicial procedure
of the Colony" in the face of the declared dissent of
the Chief Justice of the Colony.

Finally Your Honour expresses regret
thet a scheme of this nature "should have been proposed
by the Government and sanctioned at Home without the
opinion of the Chief Justice being taken upon it". The
facts, however, set out in your paragraph (9) appear to
me to have been overlooked by Your Honour in this commection,
and to shew that as long ago as some date prior to November
10 th.
